Conservation Commission
Meeting
October 2, 2003

Peg Arguimbau Chairman, Katherine Roth, Janet Dunlap and Hank Langstroth were the members present.

7:45 p.m., N.O.I Hearing Continuance. DEP # SE-280-441. Applicant- Gary Steinberg, 298 Mansfield St.  Proposed in-ground pool installation:

Gary Steinberg appeared before the Commission.
Jane Cote from Easton Pool & Spa represented the Applicant and submitted revised site plan dated 9/23/03 to the Commission.
Greg explained to the Commission that the 13-acre lot was originally subdivided land owned by Peter Andrews.
To allow the construction of the existing house and driveway, a Conservation Restriction requirement was part of the original filing.
Greg is in the process of drafting a Conservation Restriction concerning the wetland area of the property.
The Applicant would like to continue utilizing the high and dry areas of the property for his landscaping business.
All of the proposed work is within the existing yard. The lot has previously been cleared. No additional clearing is proposed for the project.
The proposed pool is approximately 85' from the wetland line.
Comments are pending from the Massachusetts Natural Heritage and Endangered Species Program regarding habitat issues.
Peg stated that the Orders of Conditions would be released upon the signing of the Conservation Restriction.
Peg called for a motion to close the hearing pending receipt of the letter from Natural Heritage.
Hank moved. Kathy seconded. Voted. Unanimous.

8:00 p.m., N.O.I. Tony Nakhle- T.N. Real Estate & Development Co. Proposed construction of driveway and site preparation associated with construction of a dwelling on property currently owned by the Elizabeth Peabody House/Camp Gannett:

Abutter, Mr. Kofi Adjorlolo, 216 Morse Street, was present in the audience.
Todd Pilling, Engineer from Pilling Engineering represented the Applicant and submitted the green abutter cards to the Commission. He reviewed the On-Site Sanitary Disposal System Plan dated 9/25/03 with the Commission.
Todd explained to the Commission that Camp Gannett is a 22 & ½ acre lot. The Camp is interested in selling 7,200
The proposed construction of the 12' wide driveway and a portion of the dwelling are inside the 100' Buffer Zone of a BVW, and outside of the 50' No Disturb Line.
The Commission reviewed the "Form A Plan" endorsed by the Planning Board.  
There is a drainpipe on the property that flows towards Morse Street.
(The Applicant proposes to convey a drainpipe easement to the Town.)
Mr. Kofi Adjorlolo expressed concern that the neighboring basements may experience flooding due to the impact of the underground water flow.
Todd stated that the Board of Health would not endorse the proposed plan until the lot has been created.
Peg asked Todd to extend an invitation to Camp Gannett and to Ann Marie Carpenter from the Elizabeth Peabody House to meet with the Commission to discuss the resources to the wetlands that feed Lake Massapoag.
Peg called for a motion to continue the hearing until the 16th of October.
Hank moved. Kathy seconded. Voted. Unanimous.

8:25 p.m., Discussion of a Grant Application to Install Butterfly Garden at Beach Tree Park
Peg explained to the members of the Commission that she has endorsed a $3,000.00 Grant Application on behalf of the Commission for the installation of native species of plants for attracting butterflies at Beach Tree Park.

                 preparation. DEP File # SE-280-431:

The Commission discussed the possibility of putting a Conservation Restriction on the property.
Due to the absence of the Applicant, it was the consensus of the Commission to continue the Hearing until further notified by the Applicant.
     
8:35 p.m. Other Issues:

Update on Rattlesnake Hill:
Greg explained to the Commission that he recently attended a ZBA Hearing regarding the hydrogeologic report at Rattlesnake Hill. The report stated that the discharge from the treatment plant on the proposed site would probably
flow underground into one of the large vernal pools traveling towards Bay Road.  
The ZBA requested Greg to visit the site to inspect the vernal pool before the next scheduled ZBA Hearing.
Greg told to the Commission that he has submitted a letter to the ZBA requesting the following additional conditions regarding the Rattlesnake Hill proposed 40B:
No irrigation wells within the 100' Buffer of any wetlands.  
Establish a limit of work and everything outside the limit of work should either be restricted or deeded  to the Town.

Update on the proposed 40B on Mansfield Street:
Greg told the Commission that he is arranging a meeting with the Trust for Public Land, The Landowner, and Mr. Wluka.
In a letter that Greg submitted to the ZBA regarding the proposed 40B on Mansfield Street, Greg stated the following Commission's concerns:
The Commission is not pleased with the layout and density of the proposed project.
The Commission would like to see further mitigation.
The septic systems to be in compliance with the Board of Health Rules and Regulations.

Update on Feasibility Study
Peg distributed copies to the Commission of the Final Status Report from Hiller Associates.

The Commission discussed strategies for presenting a cost benefit analysis statement to the public regarding the acquisition of Rattlesnake Hill.

9:10 p.m. Approve Past Meeting Minutes:

The Commission moved to accept the 9/18/03 Executive Session Meeting Minutes.
Hank moved. Peg seconded. Voted. 2-0-2.

Peg called for a motion to accept the September 18, 2003 Meeting Minutes as amended with corrections.
Hank moved. Peg seconded. Voted. 2-0-2.
